Does a Food Truck Need an EIN?

Liability is the reason most operators choose an LLC. A food business carries risk that a desk business does not — foodborne illness claims, a propane incident, a vehicle collision during service — and a sole proprietorship puts personal assets behind all of it. What Taxes Does a Food Truck File Under Its EIN?
The EIN identifies the business on every federal filing. Which returns you file depends on the entity you chose and whether you employ anyone.

Two of these deserve attention before the first season.

Sales tax is separate from the EIN entirely. You collect it under a state seller’s permit and remit it to the state, on the state’s schedule. What Permits Does a Food Truck Need Beyond the EIN?
The EIN is federal and identifies the business to the IRS. Everything that authorises you to cook and sell is state, county, or city, and none of it is covered by the EIN.
